The Following is a Mortgage at Hackenthorpe dated November 18th, 1887

Mortgage – Freehold hereditaments situate at Hackenthorpe in the County of Derby

Mr George E Swithenbank to Mr James William Innes

Transfer of Mortgage

This indenture made the Eighteenth day of November One Thousand Eight Hundred and Eighty Seven between EDWIN SWITHINBANK of 4 Tokenhouse Buildings in the City of London Chartered Accountant (Hereinafter called the transferor) of the one part and JAMES WILLIAM INNES of Sheffield in the County of York Chartered Accountant (hereinafter called the transferee) of the other part WHEREAS whereas on the Twenty Ninth day of August One Thousand Eight Hundred and Eighty Two (29th August 1882) FREDERICK PARKER RHODES in accordance with the provisions in that behalf contained in the Bankruptcy Act 1869 presented a petition in the Sheffield County Court for the liquidation for his affairs by arrangement and at the first general meeting of his creditors duly convened and held on the Fifteenth day of September One Thousand Eight Hundred and Eighty Two (15th Sept 1882) a special resolution was duly passed that the affairs of the said FREDERICK PARKER RHODES should be liquidated by arrangement and not in bankruptcy and that the said GEORGE EDWIN SWITHINBANK should be appointed trustee under the said liquidation AND WHEREAS by an order of the Sheffield County Court dated the Sixth day of September One Thousand Eight Hundred and Eighty Two (6th Sept 1882) the said THOMAS WRIGHT BADGER was adjudicated a bankrupt and at the first general meeting of his creditors duly convened and held on the twenty seventh day of September One Thousand Eight Hundred and Eighty Two (27th Sept 1882) a resolution was duly passed that the said GEORGE EDWIN SWITHINBANK should be appointed trustee of the property of the bankrupt ….continues……… It was ordered (amongst other things) that such matters be amalgamated in respect of the joint properties of the said FREDERICK PARKER RHODES and THOMAS WRIGHT BADGER AND WHEREAS the principal sum of thirty pounds (£30) secured by the within written indenture remains owing to the transferor with some interest thereon AND WHEREAS the transferor has agreed to sell to the transferee the benefit of the within indenture of mortgage for the price of five pounds (£5) and to make such transfer thereof as hereinafter mentioned NOW THIS INDENTURE WITNESSETH that in consideration of FIVE POUNDS to the transferor paid by the transferee on or before the execution of these presents (the receipt whereof the transferor hereby acknowledges)……..continues………..TO HOLD the same unto and to the use of the transferee in fee simple subject to the within recited indenture of mortgage of the Tenth day of May One Thousand Eight Hundred and Seventy Seven (10th May 1877) for securing three hundred and fifty pounds (£350) and interest and also subject to such right or equity of redemption as is now subsisting in the said premises under or by virtue of the within written indenture IN WITNESS whereof the said parties to these presents have hereunto set their hands and seals the day and year first hereinbefore written
