THIS INDENTURE made the First day of September One Thousand Eight Hundred and Eighty BETWEEN THOMAS BRADSHAW of South Bailey in the County of Durham Esquire and THE RIGHT REVERAND HENRY SEYMOUR of Holme Pierrepont in the County of Nottingham Clerk of the first part THE RIGHT HONOURABLE SIDNEY WILLIAM HERBERT EARL MANVERS of the second part THE MOST NOBLE ALGERNON GEORGE DUKE OF NORTHUMBERLAND of the third part HUGH EDWARD EGERTON of number 15 Eaton Place in the county of Middlesex Esquire and HENRY SIDNEY SEYMOUR of Holme Pierrepont in the County of Nottingham Esquire of the fourth part and THE SCHOOL BOARD of the Parish of Beighton in the County of Derby (hereinafter called The “School Board”) of the fifth part Whereby an Indenture dated the 21st day of June One Thousand Seven Hundred and Seventy Six (1776) and expressed to be made between the said SYDNEY HERBERT EARL MANVERS and the HONOURABLE CHARLES WILLIAM SYDNEY PIERREPONT commonly called VICOUNT NEWARK of the first part the said THOMAS BRADSHAW and HENRY SEYMOUR of the second part and EVELYN HARDOLPH HARCOURT VERNON and HENRY SYDNEY SEYMOUR of the third part (being a settlement by the said SYDNEY WILLIAM HERBERT EARL MANVERS and CHARLES WILLIAM SYDNEY VISCOUNT NEWARK of their family estates) the said SYDNEY WILLIAM HERBERTEARL MANVERS and CHARLES WILLIAM SYDNEY VISCOUNT NEWARK in exercise of the powers in that behalf given to them by a certain Indenture dated the day next before the day or the date of the Indenture now in recital and of every or any other power enabling them or either of them in that behalf directed limited and appointed that CERTAIN MANORS MESSUAGES LAND AND HEREDITAMENTS OR FREEHOLD TENURE INCLUDING THE HEREDIATEMENTS HEREINAFTER EXPRESSEDTO BE HEREBY APPOINTED and which together with certain moneys and funds and certain copyhold hereditaments by the Indenture now in recital also settles their constituted and are hereinafter collectively referred to as the said “settled estates” and are of very great value (subject and without prejudice to the several charges and incumbrances affecting the same and specified together with a certain rent charge now affecting the hereditaments hereinafter expressed to be hereby appointed in the first schedule hereto wherein are set forth the dates and other particulars of the instruments creating such charges and terms of years and the name of the respective persons (other than the mere termors in trust for securing the said jointure rent charge)…………………………………continues……………………………

AND WHEREAS ……….CONTINUES……(page4) the said THOMAS BRADSHAW and HENRY SEYMOUR as such trustees as aforesaid and ion exercise of the power of sale hereinbefore recited and with the consent (Hereby testified) of the said SYDNEY WILLIAM HERBERT EARL MANVERS has agreed to sell to the said School Board the unencumbered fee simple in possession of the hereditaments hereinafter expressed to be hereby appointed subject to the exceptions reservations and stipulations hereinafter contained at the price of One Hundred and Fifty Nine Pounds Three Shillings and Nine pence (£159 3shillings 9pence) AND WHEREAS the said ALGERNON GEORGE DULKE OF NORTHUMBERLAND and HUGH EGERTON and HENRY SYDNEY SEYMOUR being satisfied that the rest of the settled estates subject to their respective charges and incumbrances are an ample security for the whole of the monies intended to be thereby secured have agreed that the said purchase money should be paid to the said THOMAS BRADSHAW and HENRY SEYMOUR and to release from the said incumbrances the said premises hereinafter expressed to be hereby released and to join in these presents in manner hereinafter appearing……..CONTINUES…

(Page 5) FIRSTLY ALL that plot piece or parcel of land situate and being at Beighton in the County of Derby bounded on or towards the North and East by other parts of the said settled estates on or towards the South by land the property of MR CHARLES WRIGHT and on or towards the West by the bye road leading from Beighton aforesaid to Killamarsh and which plot piece or parcel of land is now in the occupation of the said SCHOOL BOARD and contains by recent admeasurement one acre or thereabouts and is more particularly delinated in the first plan drawn in the margin of these presents and thereon coloured GREEN and secondly ALL THAT other plot piece or parcel of land situate at Hackenthorpe in the Parish of beighton aforesaid bounded on or towards the North by the piece of land called the HACKENTHORPE RECREATION GROUND on or towards the South and West by land the property of MR JONATHAN RHODES and on or towards the East by a lane there called BROOK LANE and land respectively the property of MR CHARLES STANIFORTH and MR HUGH HOYLAND and which plot piece or parcel of land is now in the occupation of the said SCHOOL BOARD and contains in the whole by admeasurements one acre and twenty one perches or thereabouts and is more particularly delineated in the second plan drawn in the margin of these presents and thereon coloured PINK (Page 6) Shall go and remain to the use of the said SCHOOL BOARD and their assigns FOREVER and UPON TRUST for the purposes of the Public Elementary School or Public Elementary Schools within the meaning of “The Elementary Education Act 1870” and FOR NO OTHER PURPOSE WHATSOEVER………….CONTINUES…..

That they the said SCHOOL BOARD or their assigns will forthwith make and forever thereafter maintain in good repair good and substantial walls or such other fences as may be agreed upon and of the height of four and a half feet on those side of the said piece or parcel of land firstly hereinafter described and expressed to be hereby appointed which abut upon other parts of the said settled estatesAND ALSO the said SCHOOL BOARD and their assigns will not at any time hereafter use the said premises hereinbefore expressed to be hereby appointed for any other purpose than for the purposes of a Public Elementary School or Public Elementary Schools within the meaning of the “Elementary Education Act 1870”……………………continues………………….
